Now they've done it! Just OWNING "hacker tools" illegal in Germany

Bild von hadez

Update
For our German speaking readers, please watch this video .
Those are the folks who are part of the ones banning “hacker tools”.
It’s so ridiculous.. neither do they really use the internet, nor do they know what a “browser” is.
BUT, they have their own homepage which they are (admittedly) too stupid to use on their own.

German news: http://www.heise.de/newsticker/meldung/92334/from/atom10
Statement from German hacker group Phenoelit: http://www.phenoelit.de/202/202.html

In short:
If you own any hacker tool which “aim is to commit a crime”...

  • nmap
  • metasploit
  • any penetration testing tool in general
  • port scanners
  • network analyzers? (hopefully not those too)

... you’re signing up for one year in jail or a hefty fine.
That reads OWNING, not using, it’s just OWNING.

Furthermore, if you make public any passwords or codes that allow access to data (read “default password list”, or strictly speaking even: “if you start your linksys router for the first time, log in using USER:PASS”) you’re screwed.

I’ve been using computers since the 80’s.
I’ve been studying computer science / computer engineering for four years now.
Not even did you (yes, you, German government) ignore the “education should be free for everyone” rule in the constitution (like all those other constitutional rules you’ve been violating so willingly lately).
No, now you’re taking away my (100% legally OK, until today that is) future work, just at the time I was about to finish my studies after paying over 500 cold hard euros, per semester, out of my own pocket, to actually be able to finish at all.

I’m done with all of this bullshit, as soon as possible I’m out of here.
No thanks for being so nice to all of us.

And yet you keep crying about how IT specialists are so rare right now and all those companies who’re leaving Germany for some other country because it just plain sucks here.

It’s time to make use of the German constitution, use as in “Article 20 (4)”.
RESISTS, as the constitution demands of every Germany citizen.
DISOBEY the unconstitutional fascists in power right now.

The spirit

Dude, i know what you’re talking about. They are really loosing it….

But I think your spirit should be different: “I’m done with all of this bullshit, as soon as possible I’m out of here.”

let’s make that:
“I’m done with all of this bullshit, as soon as possible I’m IN THERE”

:)

true dat

It’s dirty business, but hell yeah.
Maybe i’ll make it into politics some day
Or start / contribute to a lobby (we do have more than one IT lobby in Germany, but it looks like they are not doing much)

me liky

you!

great posting. watch out my blog – “how germans copy”... its a shame to life in this country… only stupid fucks. especialy the “SEO” guys… they ranking for who is the most stupid one…

FUCK

Fucin Nazi’s
No offense, but IT guys are rare and by making a program illegal to OWN is total bullshit, have you ever heard that guns dont kill people, people kill people with guns. Same deal here. Its what you do with the program.
Cops carry guns, army carries guns, buts the context in which they are used. Same with programs.

Does this mean that I'll be arrested, if I visit Germany? :D

Really, are you sure about packet analyzers (I don’t speak German)?
If so, it is not a good idea: packet capture/network monitoring tools and libraries very often are used for non-intrusive data gathering even in hospitals…

Bild von hadez

not exactly sure

Well, I’m not sure about the packet analyzers, hence the comment in the brackets behind it.
But since you…

  • Can use packet analyzers to spy on traffic
  • Making passwords public is illegal
  • Passwords are often sent plain text over network

There is a certain possibility ;-)
But that’s a long shot, I have to admit that.
Besides that, this law is written in the typical fuzzy, squishy, you-can-interpret-it lawyer-German…

This violates computers!

This violates computers? Some of the tools are embedded in all distros of GNU/Linux, *BSD, and, even, Microsoft!

This law is stupid beyond comprehension, because it outlaws all network administration by legitimate owners of networks!

In fact, if this were about motor vehicles, it would be tantamount to outlawing lug wrenches and all tire changing equipment!

Governments are only as smart as their most illiterate dumbass politician!

Bild von hadez

this law will be used...

as soon as they catch someone, like those nasty little torjan horse writing teens
they’ll use laws like this to make their life miserable beyond comprehension.
it’s not that i like what those those kiddies do, but that’s just an example.

make something almost everyone that might do something else (which is illegal already) illegal.
just to have more leverage to get them with 200% chance.
even if you were innocent of the “real crime”, they could still get you for owning some crappy software you never used in a wrong way

Wow, history is repeating itself...

First the Jews, now the hackers? WHEN WILL THEY LEARN?

Time for WWIII... Finally! All those WWII games are starting to get old!

Bild von housetier

See ya in jail!

I am in possession of these “weapons”, I admit it. I don’t use them often because my home network is too small to be remotely audited.

Nevertheless, it’s about possession, and I possess. So, see you in jail soon!

OWNING !!!

i own lots of tools and use them.. :P thank god its only in germany not in my country :))

Can Anyone Say Anti-Linux?

This is ridiculous. Anybody who has a copy of any unix-based system (Linux, OS X, BSD, ...) is in violation of the law. The are essentially outlawing all of these operating systems, and in turn the use and development of open source software in Germany..
